When you appeal and when you might get sent back before the very same judge

When people receive an unfavorable result in a trial court, they have a right to appeal. However, most people don’t understand that the usual best case scenario is that the matter will be sent back for trial before the very same judge. It is very rare for the appellate court to reverse the case and make a decision. For the most part, they will send the matter back, possibly for a completely new trial, in front of the very same judge. Reversal on appeal is not grounds to obtain a new judge.
