MISSISSIPPI ADOPTS UNIFORM INTERSTATE DEPOSITIONS AND DISCOVERY ACT

The Mississippi Legislature has passed SB 2264 which adopts the Uniform Interstate Depositions and Discovery Act. Prior to adoption of the Act, there was no clear procedure in Mississippi for taking discovery in Mississippi in foreign actions. Now, the procedure is clear and easy. If a litigant in another State desires to issue a subpoena for deposition, production of documents, or inspection of property to a Mississippi citizen or entity, they need only submit the foreign state’s subpoena to the clerk in the County where the discovery is sought and the clerk will be required to issue a Mississippi subpoena to the Mississippi citizen or entity.
