Child Custody

Court is still not awarding support to disabled adult children.

In BURRELL v. BURRELL, NO. 2018-CA-00760-COA , (Decided Jan. 7, 2020), the Court of Appeals affirmed a denial of child support for an adult child that was disabled. The Mother complained on appeal that the child could not care for himself; requires substantial assistance; and has never resided on his own. The Court of Appeals affirmed the trial judge’s denial of assistance. The Court stated that it has held that “[a] parent has no statutory or common-law duty to support a child who has reached the age of majority.” Archie v. Archie, 126 So. 3d 937, 942 (Miss. Ct. App. 2013) The Court also observed that the son received monthly Social Security benefits and had not been made a party to the proceedings.
