Landmark Cases That Changed Mississippi Law
Some of Mark's most significant appellate work has produced decisions that continue to guide Mississippi courts today.
In Singley v. Singley, 846 So. 2d 1004 (Miss. 2002), Mark represented the appellee before the Mississippi Supreme Court in a complex divorce appeal involving equitable distribution, marital fault, rehabilitative alimony, inherited assets, and the valuation of a professional practice. The Court's resulting opinion established a critical precedent: that professional goodwill should not be treated as a divisible marital asset when valuing a business for divorce purposes. It remains one of the defining rulings in Mississippi divorce law.
In Jones v. Jones, 995 So. 2d 706 (Miss. 2008), Mark represented the appellant before the Mississippi Supreme Court in a matter involving serious discovery abuse, perjury, and destruction of evidence. The Court reversed in part and remanded, directing the lower court to consider sanctions and a potential criminal referral, a powerful outcome reflecting the strength of the appeal.
In Johnson v. Johnson, 297 So. 3d 342 (Miss. Ct. App. 2020), Mark successfully argued before the Court of Appeals that the lower court had failed to properly conduct and articulate a required Ferguson analysis on the record in dividing marital assets, including a home, military benefits, rental property, and retirement accounts. The Court reversed and remanded, a win built entirely on appellate knowledge and strategic legal argument.
