Mississippi Requirements for an Uncontested Divorce

Mississippi recognizes irreconcilable differences as its no-fault ground for divorce. An irreconcilable differences divorce generally requires mutual consent, proper service or a valid waiver, and compliance with state filing requirements.

The spouses ordinarily need a written property settlement agreement resolving their property rights. When applicable, the settlement also must address child custody and parenting time, child support, maintenance, and other family obligations. A complaint based on irreconcilable differences generally must remain on file for at least 60 days before it can be heard.

An agreed divorce isn’t necessarily simple. Real estate, retirement benefits, incomplete financial records, or unclear parenting terms may require additional review even when neither spouse wants a contested hearing.

Issues to Resolve Before an Uncontested Divorce

A complete settlement should address each material issue that applies to the marriage. An unresolved financial interest, debt, or parenting obligation can create legal and drafting questions that must be addressed before the court considers the proposed divorce.

Depending on the circumstances, settlement terms may need to cover:

Marital property: Real estate, vehicles, bank accounts, personal property, business interests, and other assets acquired during the marriage.
Separate property: Assets claimed by one spouse and the facts or records supporting that claim.
Debts: Mortgages, credit cards, loans, tax obligations, and responsibility for future payments.
Retirement benefits: Pensions, workplace retirement plans, and individual retirement accounts that may require precise settlement language.
Children: Legal and physical custody, parenting time, child support, health-related expenses, and other parental responsibilities.
Alimony: Whether support is included, waived, or otherwise addressed based on the parties’ circumstances and proposed terms.

DeSoto County Chancery Court Procedures

The county is part of Mississippi’s Third Chancery District. Its Chancery Court handles divorce, alimony, child support, and child custody cases, including filings based on irreconcilable differences.

County instructions for self-represented parties reference a Rule 8.05 financial statement, a standardized disclosure of income, expenses, assets, and liabilities required under Mississippi Uniform Chancery Court Rule 8.05. Supporting financial documents may also be needed when the case is placed on the court docket.

The instructions state that both parties should attend the hearing unless the judge excuses one spouse. They also direct the parties to bring a proposed order or decree for the judge to consider signing. The required documents and hearing procedures may vary based on the facts, filing posture, and court instructions.

Preparation may include confirming required financial disclosures, organizing the settlement terms, drafting the proposed final decree, and verifying that the filing accurately reflects the spouses’ decisions. Approval and timing remain subject to Mississippi law and the court’s review.
