Modifications Helping Families Regain Their Strength

Divorce Modification Attorney in DeSoto County

More Than 40 Years of Family Law Practice Guides Your Case

A court order that no longer fits your family’s circumstances may call for a targeted modification rather than another dispute over the original divorce or custody decision. At Chinn & Associates, PC, we evaluate and pursue changes to custody, visitation, child support, and alimony orders.

We assess whether the change is significant and continuing, how it affects the current order, and what evidence supports the requested terms. Relevant circumstances may include:

  • Parenting arrangements: Relocation that disrupts school or parenting time and a new work schedule that no longer fits the parenting plan.
  • Child well-being: Safety concerns and evolving medical, educational, or emotional needs.
  • Financial obligations: Income changes, job loss, disability, major child expenses, retirement, and new financial resources.

Mississippi Standards for Modifying Family Court Orders

Mississippi courts usually require a material and continuing change in circumstances before modifying custody, support, or alimony. The change must be substantial enough to affect the current arrangement. A temporary setback or minor inconvenience generally isn’t enough.

Custody Modification

A parent seeking custody modification generally must prove an unanticipated material change in the custodial home, an adverse effect on the child, and that changing custody serves the child’s best interests. Once that threshold is met, courts reapply the Albright factors used in Mississippi to assess a child’s best interests.

A joint custody order may be modified or terminated when both parents petition for the change. One parent may also seek new terms by proving a substantial shift in circumstances under the applicable standard.

Visitation Modification

A visitation modification focuses on whether the current schedule works and whether the requested adjustment would benefit the child. We evaluate changed work hours, school demands, and relocation. We also consider recurring scheduling conflicts in light of the child’s needs.

Child Support Modification

Child support modification generally requires a substantial, material, and unforeseeable change involving a parent or child. Income loss, disability, or major child-related expenses may warrant review, but the evidence must show more than a brief fluctuation.

Modification applies going forward. Past-due child support can’t be reduced through a later request because each unpaid installment becomes fixed when it’s due.

Alimony Modification

For an alimony modification, we evaluate whether a significant and continuing financial shift supports revising the order. Relevant factors may include income changes, retirement, and disability. We also consider a recipient’s new financial resources, depending on the order’s terms and the surrounding circumstances.

What to Expect During a Modification in DeSoto County

Family law matters involving divorce-related parenting and financial orders are heard by the DeSoto County Chancery Court. A case begins with a request to change a current court order and evidence supporting the proposed terms.

Our process starts with a review of the order, the events that followed, and your current goals. We gather relevant evidence, organize the case through detailed trial scripts, and draft proposed orders in-house. We then prepare you for negotiation or a hearing.

Many cases resolve through negotiated terms and agreed orders that record the parties’ approved changes. When an agreement isn’t reached, we prepare the evidence and requested relief for the court. The duration depends on the disputed issues, available documentation, and the court’s schedule.

Our transparent flat fee is agreed upon at the outset, with no hourly billing or hidden costs. You know the fee structure before modification work begins.

“I highly recommend Attorney Mark Chinn”

I highly recommend Attorney Mark Chinn. He’s all about lessening the impact on the family members. I had a very contentious divorce, and he walked me through every step of the way. Glad I followed his advice. And he’s not the most expensive I found him very reasonable, considering the time it took to complete.

I just wanted to take a moment to express my sincere gratitude for your generosity in sharing your CLE materials with me. Your insights and expertise have long been an inspiration, not just in Mississippi family law but on the national stage as well. Your leadership in value billing has truly shaped the way family law attorneys approach their practice, and I deeply respect the impact you've had on our profession. Beyond your professional accomplishments, I've always admired the incredible successes of your family. Watching your daughters thrive in their own careers and families over the years has been a joy. It must have been an especially proud moment to present a CLE alongside Carly what a remarkable testament to your influence both as a lawyer and as a father. It has been an honor to know you and call you a friend over the years. Thank you again for your kindness and generosity. I truly appreciate it...and wish continued success to you!
