What a Mississippi Premarital Agreement May Cover

A prenuptial agreement is a written contract completed before marriage that generally takes effect when the marriage occurs. Depending on its terms and applicable Mississippi law, it may address financial rights and responsibilities during the marriage and after divorce or death.

Common subjects include:

Rights involving marital property and income
Responsibility for individual or shared debts
Disposition of property after divorce or death
Certain terms involving spousal support
Treatment of business interests and inherited assets

An agreement can’t finally determine child custody or eliminate a child’s right to support. Child custody and child support remain subject to applicable law and the child’s best interests when a court decides those issues.

What Courts May Consider If an Agreement Is Challenged

If an agreement is later disputed, a court may examine how it was prepared and signed. Relevant considerations may include voluntary execution, financial disclosure, the opportunity for meaningful legal review, and whether the terms were unconscionable when executed. In this context, unconscionable generally means so fundamentally unfair that enforcement may raise serious legal concerns.

Timing & Voluntary Signing

Presenting an agreement shortly before the wedding may raise questions about pressure and whether the other party had enough time to understand the terms. We recommend completing the process well in advance whenever possible. Anyone who receives a late proposal should obtain legal advice before signing.

Financial Disclosure

Meaningful financial disclosure generally includes assets, liabilities, income, real estate, investments, and business interests. Missing or inaccurate information may become significant if the agreement is challenged later.

Independent Legal Counsel

Each prospective spouse should have the opportunity to consult independent legal counsel about individual rights and obligations. Our published guidance recommends separate counsel and careful review of provisions that may be fundamentally one-sided.

Amendment or Revocation

If spouses later want to change or withdraw provisions, applicable law may require a written amendment or revocation. The proper method depends on the agreement and the circumstances surrounding the proposed change.
