How Divorce Mediation Works
Divorce mediation is a facilitated negotiation in which spouses work toward agreements instead of asking a court to decide every unresolved issue. It isn’t limited to couples who already agree on every term. Both spouses must participate in negotiations, and issues they can’t resolve may still require a court process.
Our goals are to keep the divorce process orderly, reduce the cost and difficulty associated with litigation, and tailor the agreement to the spouses’ and children’s needs. We can also provide limited-scope legal representation, with our involvement confined to agreed services such as assisting with the finalization of an agreement in court.
Our Divorce Mediation Process
We begin by identifying the issues that require discussion and your priorities for resolution. During mediation, we present your goals and perspective clearly while the spouses work toward terms they can both accept.
The spouses control the pace rather than waiting for each stage to move according to a court docket. Our mediation process generally takes approximately two to six months, although the complexity and number of unresolved issues affect the timing.
When negotiations produce an agreement, the resolved terms are placed in a written divorce agreement for court review. That agreement provides the basis for finalization, but mediation itself doesn’t end the marriage or replace the court’s role.
Issues Addressed in Lafayette County Divorce Mediation
Mediation can address the terms spouses must resolve before presenting an agreement to the court. Our approach keeps the parties’ needs and the healthy development of their children central to negotiations.
Common subjects addressed through mediation include:
- Child custody and parenting arrangements
- Child support and related terms
- Alimony
- Property division and financial obligations
Mississippi applies equitable distribution to marital property, meaning the court seeks a fair division rather than necessarily an equal one. In an irreconcilable-differences divorce, spouses may include child custody, child support, and property terms in their written agreement. If the chancellor finds the agreement adequate and sufficient, it becomes part of the divorce judgment.
Most divorce, alimony, and child custody matters in Lafayette County, Mississippi, are heard in Lafayette County Chancery Court. Venue and jurisdiction can depend on where the spouses or child live and whether another court previously entered an order.
Divorce Mediation Cost & Timing
Mediation can often resolve divorce issues in less time and at a lower cost than litigation. A divorce negotiated between two adversarial lawyers can cost each spouse $15,000 or more, and significantly more if the case goes to trial. Actual cost and timing depend on the complexity of the unresolved issues and the spouses’ ability to reach an agreement.
We use customized value pricing and a flat-fee model, with an agreed cap on the total cost established before representation begins. This structure provides clarity about legal fees without promising a particular timeline or savings amount. Any mediated agreement must still receive court review before the divorce is finalized.

I highly recommend Attorney Mark Chinn. He’s all about lessening the impact on the family members. I had a very contentious divorce, and he walked me through every step of the way. Glad I followed his advice. And he’s not the most expensive I found him very reasonable, considering the time it took to complete.
